General terms and conditions of RECCO Shop

1 Validity towards entrepreneurs and definitions of terms
(1) The following general terms and conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.

A consumer is any natural person who concludes a legal transaction for purposes that cannot primarily be attributed to their commercial or independent professional activity (Section 13 BGB).

2 Conclusion of a contract, storage of the contract text
(1) The following regulations regarding the conclusion of the contract apply to orders via our online shop http://www.reccoshop.de.

(3) The presentation of the goods in our online shop does not constitute a legally binding contractual offer on our part, but is only a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer makes a binding offer to conclude a purchase contract.
(4) When an order is received in our online shop, the following regulations apply: The consumer submits a binding contractual offer by successfully completing the ordering procedure provided in our online shop.

The order takes place in the following steps:

1) Selection of the desired goods
2) Confirm by clicking the “Order” button
3) Checking the information in the shopping cart
4) Press the “checkout” button
5) Register in the online shop after registering and entering the registration details (email address and password).

Before the order is bindingly sent, the consumer can go back to the website on which the customer's information is recorded and correct input errors by pressing the "Back" button in the Internet browser he is using and after checking his details Closing the internet browser will cancel the ordering process. We confirm receipt of the order immediately by an automatically generated email (“order confirmation”). With this we accept your offer.

(5) Storage of the contract text for orders via our online shop: We will send you the order data and our general terms and conditions by email. You can view the terms and conditions at any time at https://reccoshop.de/agbs/index.html. For security reasons, your order details are no longer accessible via the Internet.

3 Prices, shipping costs, payment, due date
(1) The prices stated include statutory sales tax and other price components. In addition, there are any shipping costs.

(2) The consumer has the option of paying in advance.

(3) If the consumer has chosen to pay in advance, he undertakes to pay the purchase price immediately after conclusion of the contract.

4 delivery
(1) Unless we have clearly stated otherwise in the product description, all items we offer are ready for immediate dispatch. Delivery takes place within 5 working days at the latest. In the case of payment in advance, the deadline for delivery begins on the day after the payment order is sent to the bank responsible for the transfer and, for all other payment methods, on the day after the contract is concluded. If the deadline falls on a Saturday, Sunday or public holiday at the delivery location, the deadline ends on the next working day.
So that customers can track their order using the “DHL Parcel” shipping method, REECO-SHOP stores the email address provided by the customer in the shipping order with DHL. This means that when the item is shipped, the customer will receive an email from DHL with shipping confirmation and tracking number.

(2) The risk of accidental loss and accidental deterioration of the item sold, even in the case of a mail order purchase, only passes to the buyer when the item is handed over to the buyer.

5 Retention of title
We reserve ownership of the goods until the purchase price has been paid in full.

You have the right to cancel this contract within fourteen days without giving any reasons.

The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the goods.

Important NOTE! Returns will only be accepted if the items are in new, undamaged condition. Furthermore, the reflectors must be unopened and in the original packaging. Since the reflectors are a safety product and reflectors whose packaging has already been opened cannot be resold, items whose packaging has been opened cannot be returned.

inform you of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, fax or email). You can use the attached sample cancellation form, although this is not mandatory.

Warranty conditions:

We give our customers a guarantee of two years from the date of purchase for all newly purchased products in our online shop. This warranty covers defects that existed at the time of purchase or are due to manufacturing defects. In the event of a defect during the warranty period, customers are entitled to free repair or replacement of the affected product, at our discretion. This warranty does not cover damage caused by misuse, negligence or normal wear and tear. To take advantage of the warranty, customers must inform us immediately upon discovery of the defect and return the defective product along with proof of purchase. This guarantee does not limit the statutory rights of customers under applicable consumer protection laws.

Payment methods:

Our online shop offers our customers a variety of payment methods to make their purchases easier. Accepted payment methods include Giropay, credit card (Visa, Mastercard, American Express), Paypal, Apple Pay, Google Pay and bank transfer.

Returns

To return an item, the buyer has the following two options to choose from.

1. The buyer returns the item to the business address provided by us and receives the full amount back using the same payment method.

2. We will send the buyer a return label that we have already paid for and will deduct the shipping costs from the refund.

In both cases, the buyer bears the return shipping costs.

Important NOTE:
Since the RECCO reflectors are safety products which may only be sold in a new and unopened condition, returns are only possible if the item is in a new and unopened condition in the original packaging.

Consequences of revocation

If you cancel this contract, we will refund to you all payments received from you, including delivery costs (except for any additional costs arising from you choosing a method of delivery other than the cheapest standard delivery offered by us have) to be repaid immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment we use the same payment method that you used for the original transaction, unless something different was expressly agreed with you; under no circumstances will you be charged any fees as a result of this repayment.

We may refuse repayment until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever is the earlier.

You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you inform us of your cancellation of this contract. The deadline is met if you send the goods before the fourteen day period has expired.

You bear the direct costs of returning the goods.
Returns are only possible in unopened original packaging.

8 Liability and Warranties
For shipments with the “letter shipping (without tracking)” shipping option, RECCO-Shop assumes no liability and no warranty in the event that a shipment does not arrive because it is not possible to trace whether the customer has received the goods. The customer can freely choose between the shipping option letter shipping (without tracking) and parcel shipping (with tracking).
Shipments sent using the parcel shipping option can be tracked using the tracking number provided.
RECCO-Shop assumes no liability and no guarantees if the customer's address information is incorrect. Goods are sent using the address details provided by the customer during the ordering process and are not checked for accuracy by RECCO-Shop. If a shipment cannot be delivered due to incorrect address details, the shipment will be sent back to the sender (RECCO Shop). In this case, the customer will be contacted by RECCO-Shop in order to check the address details again.
